Tiwi Warranty and Return Policy
Inthinc 30–Day Risk–Free Guarantee
If you are not completely satisfied with your tiwitm device, you may return the device within 30 days from the date of purchase for a full refund, subject to the terms and conditions below.
You must return the device in as-new condition in the original packaging with all components included, and you must deactivate your service by calling Inthinc Customer Care at 1-866-294-8637. Inthinc will provide you with a prepaid shipping label for your return. If you fail to return all items originally packaged with your device, Inthinc may charge you a $25 restocking fee. You will be required to include an original receipt as proof of purchase.
For items returned within the 30-day period, Inthinc will refund the purchase price paid, less any restocking fees if applicable, and refund any prepaid charges for network services and will waive the fee for early termination of your service agreement, if activated. Refunds may take up to 30 days to process after you return your device and deactivate your service.
Returning your device does not automatically deactivate your service. You must call Inthinc Customer Care at 1-866-294-8637 to deactivate your service.
Limited Warranty
Inthinc tiwi devices are driver mentoring aids, and are not intended to replace posted speed limits and other methods of safe driving. Purchaser is advised to follow posted speed limits and use good judgment while driving. READ THE USER GUIDE CAREFULLY BEFORE USING THE PRODUCT.
What this warranty covers
This limited warranty covers defects in materials and workmanship in your tiwitm device for one year from the date of purchase. Inthinc, at its sole election, will repair your device or will replace your device with a new or refurbished unit. Devices replaced under this warranty become the property of Inthinc. Replacement devices are warranted to be free from defects in materials and workmanship for 90 days or the remainder of the Limited Warranty, whichever is longer.
What this warranty does not cover
This Limited Warranty does not apply to devices used for commercial purposes and does not cover defects or damage caused by accident, misuse, abuse, neglect, fire, water, other acts of nature, power surges, unauthorized or improper modifications or repairs, improper maintenance, usage not in accordance with the product instructions, improper installation, or usage or storage in unsuitable physical or operating environments.
Exclusions
The following are excluded from the warranty coverage:
(1) periodic maintenance and repair or replacement of parts due to normal wear and tear;
(2) batteries;
(3) finishes;
(4) installations or defects resulting from installation;
(5) any damage caused by (i) shipping, misuse, abuse, negligence, tampering, moisture, liquids, proximity or exposure to heat, or improper use; (ii) disasters such as fire, flood, wind, and lightning; (iii) unauthorized attachments or modification;
(6) service performed or attempted by anyone other than an authorized Inthinc
(7) any product, components or parts not manufactured by Inthinc,
(8) that the receiver will be free from any claim for infringement of any patent, trademark, copyright or other proprietary right, including trade secrets
(9) any damage due to improper speeds resulting from inaccurate speed limit data. Inaccurate speed data can occur due to GPS inaccuracy or limitations in the speed limit data;
(10) any damage due to loss of cellular service that can occur due to service limits, failures, or outages, including and without limit, the failure of alerts, eCall emergency, priority access, or secure service calls to be connected or completed or the failure of provide alerts or accurately locate any emergency eCall;
(11) any damage due to accident, resulting from inaccurate satellite transmissions. Inaccurate transmissions can occur due to changes in the position, health or geometry of a satellite or modifications to the receiver that may be required due to any change in the GPS. (Note: Inthinc GPS receivers use GPS or GPS+GLONASS to obtain position, velocity and time information. GPS is operated by the U.S. Government and GLONASS is the Global Navigation Satellite System of the Russian Federation, which are solely responsible for the accuracy and maintenance of their systems. Certain conditions can cause inaccuracies, which could require modifications to the receiver. Examples of such conditions include but are not limited to changes in the GPS or GLONASS transmission.).
Opening, dismantling or repairing of this product by anyone other than an authorized Inthinc Service Center will void this warranty.
Exclusion of Incidental or Consequential Damages
INTHINC SHALL NOT BE LIABLE TO PURCHASER OR ANY OTHER PERSON FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DAMAGES RESULTING FROM DELAY OR LOSS OF USE, LOSS OF OR DAMAGES ARISING OUT OF BREACH OF THIS WARRANTY OR ANY IMPLIED WARRANTY EVEN THOUGH CAUSED BY NEGLIGENCE OR OTHER FAULT OF INTHINC OR NEGLIGENT USAGE OF THE PRODUCT. IN NO EVENT WILL INTHINC BE RESPONSIBLE FOR SUCH DAMAGES, EVEN IF INTHINC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some national, state, or local laws do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
How to obtain service
1. Call Inthinc Customer Care toll free at 1-866-294-8637 for return instructions. Customer Care is available 24 hours a day, 7 days a week. 2. After you provide the customer care representative with your email address, your account number and your account password, Inthinc will provide you with the forms and instructions for returning your device. 3. You must ship the device in the original packaging, and you must include the original packing slip and all items that shipped with the device. 4. Attach the prepaid return shipping label and return by mail.
Out of Warranty Repairs
If the warranty period has expired, you may be able to obtain repair or replacement service for an additional fee. Please call Inthinc Customer Care at 1-866-951-0101 or visit our website at www.Inthinc.com for more information about out-of-warranty repair and replacement options.
LIMITATIONS OF LIABILITY
INTHINC LLC MAKES NO OTHER EXPRESS WARRANTIES. ANY IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE PERIOD OF THE EXPRESS WARRANTY. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
YOUR REMEDIES ARE LIMITED EXCLUSIVELY TO REPAIR OR REPLACEMENT. WE WILL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE, PURCHASE OR REPAIR OF THIS PRODUCT, INCLUDING DAMAGES FROM LOSS OF DATA, LOSS OF PROFITS, AND LOSS OF USE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
